AgileApt follows different principles in accordance with world-wide practices to protect customer privacy and data protection.
Generally the information that personally identifies you and allows us to contact you ,is requested when you create a Registration ID on the site or when you download free software, enter a contest, order e-mail newsletters or join a limited-access premium site.
We use your Personal Information for four primary purposes:
If you choose not to register or provide personal information, you can still use most of procurEngine.com. But you will not be able to access areas that require registration. If you decide to register, you will be able to select the kinds of information you want to receive from us by subscribing to various services, like our electronic newsletters. If you do not want us to communicate with you about other offers regarding AgileApt products, programs, events, or services by e-mail, postal mail, or telephone, you may select the option stating that you do not wish to receive marketing messages from AgileApt. AgileApt occasionally allows other companies to offer our registered customers information about their products and services, using postal mail only. If you do not want to receive these offers, you may select the option stating that you do not wish to receive marketing materials from third parties.
As mentioned above, every registered customer has a unique personal profile. Each profile is assigned a unique personal identification number, which helps us ensure that only you can access your profile. When you register, we create your profile, assign a personal identification number, then send this personal identification number back to your hard drive in the form of a cookie, which is a very small bit of code. This code is uniquely yours. It is your passport to seamless travel across procurEngine.com, allowing you to download free software, order free newsletters, and visit premium sites without having to fill out registration forms with information you’ve already provided. Even if you switch computers, you won’t have to re-register – just use your Registration ID to identify yourself.
What we do with the information you share: When you join us, you provide us with your contact
information, including your name and email address. We use this information to send you updates
about your order, questionnaires to measure your satisfaction with our service and announcements
about new and exciting services that we offer. When you order from us, we ask for your credit card number and billing address. We use this information only to bill you for the product(s) you order at that
time. For your convenience, we do save billing information in case you want to order from us again,
but we don’t use this information again without your permission.
We occasionally hire other companies to provide limited services on our behalf, including packaging,
mailing and delivering purchases, answering customer questions about products or services, sending
postal mail and processing event registration. We will only provide those companies the information
they need to deliver the service, and they are prohibited from using that information for any other

personal information and to ensure that your choices for its intended use are honoured. We take
strong precautions to protect your data from loss, misuse, unauthorized access or disclosure,
alteration, or destruction.
We guarantee your e-commerce transactions to be 100% safe and secure. When you place orders or
access your personal account information, you’re utilizing secure server software SSL, which encrypts
your personal information before it’s sent over the Internet. SSL is one of the safest encryption
technologies available.
AgileApt strictly protects the security of your personal information and
honours your choices for its intended use. We carefully protect your data from loss, misuse,
unauthorized access or disclosure, alteration, or destruction.
Your personal information is never shared outside the company without your permission, except
under conditions explained above. Inside the company, data is stored in password-controlled servers
with limited access. Your information may be stored and processed in INDIA or any other country
where AgileApt, its subsidiaries, affiliates or agents are located.
You also have a significant role in protecting your information. No one can see or edit your personal
information without knowing your user name and password, so do not share these with others.
Parents or guardians: we want to help you guard your children’s privacy. We encourage you to talk to
your children about safe and responsible use of their Personal Information while using the Internet.
The AgileApt site does not publish content that is targeted to children.
However, if you are concerned about your children providing AgileApt
any personal information without your consent, AgileApt offers a Kids
account. It allows parents to give parental consent for the collection, use and sharing of children’s
(ages 12 and under) personal information online.
When you buy and install a new product, we may ask you to register your purchase electronically. When you do, we merge your registration information with any information you’ve already left with us (we call that information your personal profile). If you haven’t previously registered with us, we create a personal profile for you from your product registration information. If you ever want to review or update that information, you can visit the Profile Centre, click on Update Profile, and edit any of the Personal Information in your profile. If you haven’t already created a Registration ID, we will ask you to do so. This ensures that only you can access your information.

You must follow any policies made available to you within the Services.
Don’t misuse our Services. For example, don’t interfere with our Services or try to access
them using a method other than the interface and the instructions that we provide. You may
use our Services only as permitted by law, including applicable export and re-export control
laws and regulations. We may suspend or stop providing our Services to you if you do not
comply with our terms or policies or if we are investigating suspected misconduct.
Using our Services does not give you ownership of any intellectual property rights in our
Services or the content you access. You may not use content from our Services unless you
obtain permission from its owner or are otherwise permitted by law. These terms do not
grant you the right to use any branding or logos used in our Services. Don’t remove,
obscure, or alter any legal notices displayed in or along with our Services.
Our Services display some content that is not AgileApt. This content is the sole responsibility
of the entity that makes it available. We may review content to determine whether it is illegal
or violates our policies, and we may remove or refuse to display content that we reasonably
believe violates our policies or the law. But that does not necessarily mean that we review
content, so please don’t assume that we do.
In connection with your use of the Services, we may send you service announcements,
administrative messages, and other information. You may opt out of some of those
communications.
To protect your Account, keep your password confidential. You are responsible for the
activity that happens on or through your Account. Try not to reuse your Account password
on third-party applications.
AgileApt privacy policy explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that AgileApt can use such data in accordance with our privacy policies.
Some of our Services allow you to upload, submit, store, send or receive content. You retain
ownership of any intellectual property rights that you hold in that content. In short, what
belongs to you stays yours.
When you upload, submit, store, send or receive content to or through our Services, you
give AgileApt (and those we work with) a worldwide license to use, host, store, reproduce,
modify, create derivative works (such as those resulting from translations, adaptations or
other changes we make so that your content works better with our Services), communicate,
publish, publicly perform, publicly display and distribute such content. The rights you grant in
this license are for the limited purpose of operating, promoting, and improving our Services,
and to develop new ones. Make sure you have the necessary rights to grant us this license
for any content that you submit to our Services.
Our automated systems analyze your content to provide you personally relevant product
features, such as customized results.
If you have a Account, we may display your Profile name, Profile photo, and actions you take
on procurEngine.com.
When a Service requires or includes downloadable software, this software may update
automatically on your device once a new version or feature is available.
AgileApt gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive
license to use the software provided to you by AgileApt as part of the Services. This license is
for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided
by AgileApt, in the manner permitted by these terms. You may not copy, modify, distribute,
sell, or lease any part of our Services or included software, nor may you reverse engineer or
attempt to extract the source code of that software, unless laws prohibit those restrictions or
you have our written permission.
We are constantly changing and improving our Services. We may add or remove
functionalities or features, and we may suspend or stop a Service altogether.
You can stop using our Services at any time, although we’ll be sorry to see you go. AgileApt
may also stop providing Services to you, or add or create new limits to our Services at any
time.
We believe that you own your data and preserving your access to such data is important. If
we discontinue a Service, where reasonably possible, we will give you reasonable advance
notice and a chance to get information out of that Service.
In case there is a lapse on the part of the registered school to provide details,
documents or certificate asked by the donor’s with regard to donation already made,
on request of the donor, AgileApt has the right to deactivate the registered School on
their site and relay a message on Latest Updates visible to all registered users of X-
gen site.
In case there is lapse on the part of registered Donor to meet his commitment of
payment in time, than on request of the school AgileApt has the right to deactivate the
registered Donor on their site and relay a message on Latest Updates visible to all
registered users of AgileApt site.
We provide our Services using a commercially reasonable level of skill and care and we
hope that you will enjoy using them. But there are certain things that we don’t promise about
our Services.
Other than as expressly set out in these terms or additional terms, neither AgileApt nor its
suppliers or distributors make any specific promises about the Services. For example, we
don’t make any commitments about the content within the Services, the specific functions of
the Services, or their reliability, availability, or ability to meet your needs. We provide the
Services “as is”.
Some jurisdictions provide for certain warranties, like the implied warranty of merchantability,
fitness for a particular purpose and non-infringement. To the extent permitted by law, we
exclude all warranties.
When permitted by law, AgileApt, and AgileApt’s suppliers and distributors, will not be
responsible for lost profits, revenues, or data, financial losses or indirect, special,
consequential, exemplary, or punitive damages.
In all cases, AgileApt, and its suppliers and distributors, will not be liable for any loss or
damage that is not reasonably foreseeable.
If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify AgileApt and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.
We may modify these terms or any additional terms that apply to a Service to, for example,
reflect changes to the law or changes to our Services. You should look at the terms
regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of
modified additional terms in the applicable Service. Changes will not apply retroactively and
will become effective no sooner than fourteen days after they are posted. However, changes
addressing new functions for a Service or changes made for legal reasons will be effective
immediately. If you do not agree to the modified terms for a Service, you should discontinue
your use of that Service.
If there is a conflict between these terms and the additional terms, the additional terms will
control for that conflict.
These terms control the relationship between AgileApt and you. They do not create any third
party beneficiary rights.
If you do not comply with these terms, and we don’t take action right away, this doesn’t
mean that we are giving up any rights that we may have (such as taking action in the future).
If it turns out that a particular term is not enforceable, this will not affect any other terms.
All disputes left after exhausting the remedies under the Indian Arbitration Act, will be subject
to the Jurisdiction of Delhi Courts.
